Oct 13, Colombo: The Inspector General of Police (IGP) today informed the Court of Appeals that not enough evidence was found during investigations against former High Court Judge Gihan Pilapitiya, who has been named as a suspect in the case of former Minister Ranjan Ramanayake’s audio recording.

President’s Counsel Uditha Igalahewa, who appeared for the IGP, made this announcement when a writ petition filed by Gihan Pilapitiya seeking the annulment of the legal action taken by the police against him on the instructions of the Attorney General was called today.

The petition was called before a bench of Justices of the Court of Appeal comprising Sobhitha Rajakaruna and Dhammika Ganepola.

President’s Counsel Romesh de Silva, appearing for High Court Judge Gihan Pilapitiya, requested the court to issue an order to the Nugegoda Magistrate’s Court to release his client if sufficient evidence against him is not found during the investigation.

After considering the submissions of both parties, the Court of Appeal directed that the order on this petition be issued on the 25th.

The Attorney General had earlier instructed the Colombo Crimes Division to obtain a warrant from the Nugegoda Magistrate’s Court for the arrest of High Court Judge Gihan Pilapitiya over the controversial phone conversation the judge has had with former MP Ranjan Ramanayake.

Accordingly, after the Colombo Crimes Division reported the matter to the Nugegoda Magistrate’s Court, Gihan Pilapitiya filed a writ petition against it in the Court of Appeal.

The Judicial Service Commission suspended the services of the Embilipitiya High Court Judge over the controversial phone conversation.

The interdicted High Court Judge Gihan Pilapitiya has filed a writ petition in the Court of Appeal seeking an interim injunction order preventing his arrest.

After considering the writ petition, the Court of Appeal had issued an interim injunction suspending the proceedings against the petitioner before the Nugegoda Magistrate’s Court.
